Terms and Conditions – Love Your Birth Courses
Payment
All payments are to be made in full upon reservation - unless a payment plan has been arranged. Love Your Birth reserves the right to cancel your space on the course should payment not be received within 48 hours of us confirming your space on the course.
Where travelling expenses are included, these will be worked at the time of enquiry and payment needs to be included along with the course payment.
Love Your Birth can provide payment plans on request, at least 50% of the total course fee must be paid before beginning in this instance.
Deposits are non-refundable.
Participant Cancellation
Should your baby arrive before the course is due to take place or in the unlikely event that the course is cancelled, the course fee will be repaid back into the original bank account from which payment was made. Under no other circumstances will we be able to provide a refund.
Should you need to cancel or change the course dates in-between 15 and 0 calendar days prior to the first course date 100% of the course fee will apply.
Should you need to cancel or change the course dates in-between 30 and 16 calendar days prior to the first course date 50% of the course fee will apply.
Should you need to make any cancellations or changes to the course dates at least 31 calendar days prior to your first course date an administration fee of £10 will be charged.
GDPR
The participants agree that Emma Maguire and Love Your Birth will hold your details securely on file and computer and, in accordance with the GDPR Act 2018, you have the right to view, amend or delete your individual file by giving at least seven days’ written notice. We treat and respect your personal data and treat it with the utmost care and only keep relevant information in order for us to be able to process your booking. Under no circumstances do we sell or give your information to a 3rd party.

Using hypnobirthing techniques is not a substitute for the advice or the presence during birth or any part of pregnancy of a qualified medical practitioner. Hypnobirthing does not represent an alternative to appropriate medical care or medical advice by a professional in any way.
Should you have any questions or concerns about the use of hypnobirthing by you or a third party you should discuss this with your medical caregiver. Emma Maguire, Love Your Birth, its trainers or its representatives accepts no responsibility or liability for the inappropriate use of hypnobirthing techniques, complications or harm to you or any third party resulting from hypnobirthing techniques as a substitute for medical advice.
Hypnobirthing is intended to act as an aid to help increase the comfort of pregnancy and the birthing process and is not in any way a guarantee or promise of your expected, desired or actual outcome of pregnancy and the birthing process in any way.
Taking part in our hypnobirthing classes in part or in total by any person or third party is undertaken with the understanding by all persons or third party that no litigation or legal action can be taken and that no form of compensation or payment will be claimed or applied for at any time now or in the future against Emma Maguire, Love Your Birth and its trainers and representatives under any circumstances.
Agreement
All bookings of one of our hypnobirthing courses assumes full and informed compliance to agree with all of our terms and conditions of sale.

Love Your Birth is the controller and is responsible for your personal data (collectively referred to as ‘Love Your Birth’, ‘we’, ‘us’, ‘I’.

If you are an expectant parent, we will also collect the date that your baby is due to be born and we may also keep a record of your baby’s name and date of birth.
Under no circumstances do we, or never will, sell any of the personal data that we collect from you.

We collect information about you and any third parties such as your partner and birth partner when you use our website, for example when you contact us about our courses.

Re-marketing
Occasionally we use re-marketing to further share information with you. This involves placing a cookie on your computer when you browse our website, we then use a third party to share further information about our products and services. You have the following rights:
The right to ask for a copy of personal data that we hold about you (the right of access)
The right to request that we delete personal data held on you; where we no longer have a legal reason to retain it (the right of erasure or to be forgotten) – This may result in your contract being cancelled if the information that you have asked us to delete is required for the contract for your booking

The right to opt out of any marketing communications that we may send you and object to us using/ holding any of your personal data if we have no legitimate reasons to do so (the right to object).
The right (in certain circumstances) to ask us to ‘restrict processing of data’, which means that we need to secure and retain the data for your benefit but not otherwise use it (the right to restrict processing).
The right (in certain circumstances) to ask us to supply you with some of the personal data we hold about you in a structured- machine-readable format and/or to provide a copy of the data in such a format to another organisation (the right to data portability)

Gift Vouchers
Voucher duration. Vouchers are valid for a period of 6 months from the date of purchase. Cannot be redeemed after expiry date.
Redeemable courses. Vouchers my bee redeemed against any Love Your Birth course except the online only course.
Use of promotional codes. Promotional codes cannot be used in conjunction with gift vouchers.
Email vouchers. Email vouchers shall be provided to the email address provided at point of purchase.
Voucher redemption. Services must be pre-booked. Vouchers can be redeemed at time of booking only.
Refunds. Vouchers are non-refundable. No change or credit given in the event that the voucher value exceeds the total cost of the course – for example where a £100 voucher is used to purchase a £95 course.
Monetary vouchers. Monetary vouchers can be used for part or full payment. If the course cost exceeds the amount of the gift voucher, the balance must be paid in full by credit or debit card at the point of booking.
Course availability. Love Your Birth does not guarantee that spaces will be available on courses. Spaces are only secured once a course has been booked, so it is recommended that you book as early as possible to avoid disappointment.
Transfer. Vouchers are non-transferable and cannot be exchanged for cash.
Lost or stolen vouchers. Lost, stolen or destroyed gift vouchers will not be exchanged or refunded.
Cancellation. In the unlikely event that a course needs to be cancelled by Love Your Birth, a new gift voucher shall be issued and shall be valid for a further 6 months. In the event that a course is cancelled by a voucher holder no refund shall be given.
Birth Pool Hire Terms & Conditions
Birth Pool in a Box ECO - Regular size
Pool dimensions: 193cm x 165cm Height: 69cm
All accessories are to be purchased by you (Love Your birth can order them on your behalf)
Delivery and Deposit
Delivery will be on or before the date you have stated that you require the pool.
The full hire cost and security deposit must be paid at least 2 weeks before the hire period begins.
The £20 deposit will secure your booking and can be paid by bank transfer or by Paypal once we confirm availability for your dates.
Cancellations
Cancellation fees are as follows:
Cancellation before delivery – £10 admin fee with be retained. All other fees and the deposit will be returned.
Cancellation after delivery – Partial refund of hire fee may be available if the pool has not been opened or used, for cancellation within 72 hours of delivery.
You are responsible for the purchase of a food grade hose and pool liner.
Postage and packaging costs are not included in the hire price
The damage retainer will be returned on collection and inspection of the pool. All pools are photographed and checked before they are delivered to clients
Your responsibilities
• Upon receipt of the birthing pool you must read and follow instructions and guidelines supplied to you. If anything is unclear or you have any questions regarding these items please contact Love Your Birth immediately before use.
• It is your responsibility to get professional advice and reports from a structural engineer to confirm the area where the pool and equipment is to be installed is suitable and in a sufficient condition to do so.
• It is your responsibility to ensure your water birth is attended by experienced medical professionals.
• It is your responsibility to obtain advice from your midwife or General Practitioner before using the pool or any of the equipment provided by Love Your Birth.
• You must package items in accordance with the instructions supplied to you in order to avoid damage whilst in transit.
• You do not need to sterilise the equipment but you must return equipment in a clean state.
Damage
• A damage retainer fee of £50 is required to ensure the pool is returned clean and in good working order. The fee for the birthing pool will be £60, however this is not the maximum amount for which you will be liable for in respect of costs of repairs or replacement if damage to the pool and equipment occurs whilst on hire to you.
• The damage retainer fee will be payable by cheque to Emma Maguire, this will be held and returned to you subject to our terms & conditions.
• The damage retainer fee will be returned to you once the pool and equipment has been returned to and inspected by Love Your Birth will endeavour to return your cheque within five working days.
• If the pool or any equipment is found to be damaged we will deduct this from the damage retainer fee. If the damage retainer fee does not cover the cost of repair or replacement we will contact you to agree compensation.
Hypnobirthing Clients
Hypnobirthing clients can book the use of our pool for a lower price.
Pool hire and security deposit fees are not required for Love Your Birth Hypnobirthing clients.
Accessories pack can be ordered through Love Your Birth for £59 (does not include liner).
